Welcome to Fencegh. These Terms and Conditions govern your use of our real estate crowdlending platform. By accessing or using our services, you agree to be bound by these terms.
1. Definitions
• "Platform": The website fencegh.com and all related services • "User" or "Investor": Any person who registers and uses the platform • "Project": Real estate development listed on the platform for funding • "Promoter": Company or person presenting a project for funding • "Investment": Capital contributed by a user to a specific project
2. Eligibility
To use our platform, you must: • Be at least 18 years old • Be a legal resident of Bolivia or have legal capacity to invest in Bolivia • Provide truthful and complete information during registration • Comply with KYC verification requirements • Not be prohibited from making investments under Bolivian law
3. Nature of Investments
Real estate crowdlending carries inherent risks: • Investments are not guaranteed and you may lose part or all of your capital • Past returns do not guarantee future results • Real estate projects may suffer delays or modifications • Fencegh does not guarantee the success of any project Before investing, carefully evaluate your financial situation and risk tolerance.
4. Investment Process
When making an investment: • You must review all available project documentation • Your investment is formalized through a digital contract • Funds are transferred to the project trust • You will receive confirmation of your participation • Benefits will be distributed according to the specific terms of each project
5. User Obligations
You agree to: • Maintain the confidentiality of your access credentials • Provide updated and truthful information • Not use the platform for illegal activities • Comply with tax obligations arising from your investments • Immediately notify any unauthorized use of your account
6. Fees and Costs
Fencegh charges fees for its services: • Management fee: percentage on invested capital • Success fee: percentage on generated returns • Other applicable costs will be informed before each transaction Specific fees are detailed in each project.
7. Intellectual Property
All content on the platform, including text, graphics, logos, images, and software, is the property of Fencegh or its licensors and is protected by Bolivian intellectual property laws and international treaties.
8. Limitation of Liability
Fencegh will not be liable for: • Losses arising from investments made • Service interruptions due to causes beyond our control • Actions of promoters or third parties • Changes in legislation affecting investments Our maximum liability is limited to the amount of fees paid.
9. Dispute Resolution
Any dispute will be resolved: • First, through direct negotiation between the parties • If not resolved, through mediation at the Conciliation and Arbitration Center of the Chamber of Commerce of La Paz • As a last resort, before the competent courts of La Paz, Bolivia
10. Modifications
We reserve the right to modify these Terms and Conditions at any time. Changes will take effect upon posting on the platform. Continued use of our services constitutes acceptance of the modified terms.
11. Applicable Law
These Terms and Conditions are governed by the laws of the Plurinational State of Bolivia, including the Financial Services Law, ASFI regulations, and applicable securities market regulations.
